Susannah Posey

Susannah Posey was born 1 Jun 1691 in Charles Co., MD, the daughter of Benjamin Posey and Mary (Bayne?) (see Early Families of Southern Maryland Volume 5 by Elise Greenup Jourdan, page 36).

She apparently married John Rigg and became the mother of Thomas Rigg about 1711. Her husband died when Thomas Rigg was young.
(This assumes that John Rigg's widow, Susannah, is the same widow Susannah Rigg who married Cleborn Lomax. The alternative would be at least two Rigg males dying in Charles County, Maryland in the 1710s with at least two leaving a widow, Susannah, which does not seem to be the case.)

According to later records, Susannah was a spinster. Note that she was married at least 3 times.

This may be the same Susannah Rigg due 100 pounds of tobacco from the estate of William Elliott in 1713.

She married Cleborn Lomax, Jr. by 17 Feb 1717/18. On 17 Feb. 1717/8 Mary Posey, widow, made a gift to her son Benjamin Posey of one gelding, two cows and two yearlings and one heifer; she gave to her son Francis Posey one sorril gelding and a heifer, and she gave to her son Belayne Posey one gelding and one yearling heifer. Mary signed with her mark. "MB," and the gift was witnessed by Cleborne Lomax and Susanna (+ her mark) Lomax. (Charles Co., MD land records H2: 126, FHL microfilm 013753). This Mary Posey was Susannah's mother. Benjamin, Francis and Belayne Posey were Susannah's brothers.

Cleborn Lomax, Jr. was was born 22 January 1678/9 in Charles Co., MD.
He was alive on 13 Aug 1728 when he made a deposition regarding the bounds of a tract of land and gave his age as "fifty years or there abouts." [He was actually 49 at that time.] He was dead by 28 Jan 1728/29 when Susannah was named administratrix of his estate.

On 11 May 1729, Susannah filed the inventory of Cleborn's estate. Her brother, Francis Posey, signed the document.

On 23 May 1729 Susanah Lomax recorded a cattle mark for her son, Thomas Rigg.

The timing suggests this was related to settling Cleborn Lomax's estate. The fact that Susannah registered the mark for her son suggests that Thomas Rigg was a minor at the time.

On 27 Nov 1729 John Groves and Posthuma, his wife, filed an account of John Smoot showing cash paid to Susannah Lomax of 1 shilling, 11 pence.

On 7 Feb 1729/30 James and Mary Cashe of Westmoreland County, Virginia, gave their power of attorney to Benjamin Posey, Susannah's brother, to lease land in Charles Co., to Susannah. (COURT RECORDS, CHARLES COUNTY, MARYLAND, Book M, No. 2, p. 190)

On 12 Feb 1729/30, Susannah leased the land from James and Mary Cashe. The document was signed by her brother, Benjamin Posey, and her future husband, John McNeill. (COURT RECORDS, CHARLES COUNTY, MARYLAND, Book M, No. 2, pp. 190-191)

When Susannah filed her account of Cleborn Lomax's estate on 20 Mar 1729/30, her brother, Francis Posey, signed as security. By this time she had married John McNeal.(CHARLES COUNTY, MARYLAND, PREROGATIVE COURT ACCOUNTS OF ESTATES, Liber EHC-7, No. 10, folio 237-239)

On 10 Jun 1731, Susannah McNeale and her husband, John McNeale filed an account with the Prerogative Court. In their account they show the distribution of 1/3 of the estate to the accountants (i.e., to Cleborn Lomax's widow) and the balance to Cleborn's children. (CHARLES COUNTY, MARYLAND, PREROGATIVE COURT ACCOUNTS OF ESTATES, Liber CC-8, No. 11, folio 100-101)

The 1733 Tax List for Charles County, Maryland, William and Mary Parish, Upper Hundred, shows John McNeale living next door to Thomas Rigg.

Charles Co., MD, Court Records, August 1737: Regarding the property boundaries of a tract of land called Promise. "Susanna Macneale, aged about 40, who says that some years since, in the life of her former husband, Cleborn Lomax, he was a treating with Richard Ashman about a purchase of part of the sd tract of land....".

Thomas Rigg was in court in February and March 1738, together with his mother and step-brother, involving a warrant against John Gibson, who had taken some flour and meat out of the house of Thomas Rigg

Charles County Maryland, Mar 1738 Court Records: "Thomas Rigg, Thomas Lomax, and Susanna McNeale, appeared here this day, according to the tenor of a recognizance, before Robert Yates, Gent, last Feb. 17, for their appearance here to testify for the Proprietary against John Gibson."

Francis Posey of Charles Co., MD recorded two deeds of gift on 1 Oct 1750. These were both witnessed by John Macnail. (Charles County Land Record Book Z No. 2, page 424) I presume John Macnail was the brother-in-law of Francis Posey.

Thomas Rigg and Susanah McNeale provided depositions regarding the boundaries of the tract, Walker's Run on 20 Aug 1753. Both recalled conversations with Susanah's husband, Cleborn Lomax.

Thomas Rigg died in 1761. On 3 Dec 1761 the inventory of his estate Francis Posey, his mother's brother, signed as nearest of kin.
